The Washington State Environmental and Land Use Hearings Office (ELUHO) is updating the rules of practice and procedure of the Pollution Control Hearings Board (PCHB), Shorelines Hearings Board (SHB), and the Growth Management Hearings Board (GMHB). ELUHO may also update its Public Records rules.

ELUHO invites you to participate in the rulemaking process. This is the estimated timeline for rulemaking, including public comment periods. This estimated timeline is subject to change. Please revisit this page for any updates to the timeline.

Prenotice Inquiries – March 22, 2024

Preproposal Statements of Inquiry (CR-101) were filed with the Office of the Code Reviser on March 22, 2024:

DRAFT Proposed Rule Changes

Drafts of the proposed rules are anticipated to be posted on ELUHO’s Rulemaking Activity page on the dates listed above. ELUHO will conduct stakeholder outreach, seek informal comments, and prepare proposed rule language. Comments on proposed rules can be emailed to jamie.merly@eluho.wa.gov.

 

Proposed Rules

ELUHO will file proposed rules (CR-102) with the Office of the Code Reviser and post rule proposals on ELUHO’s Rulemaking Activity page. The public comment period will begin.

  • November 19, 2024 - Growth Management Hearings Board

  • January 2, 2025 - ELUHO, Pollution Control Hearings Board, Shorelines Hearings Board

 

Public Hearing

ELUHO will host public hearings on the proposed rules to receive oral comments.

  • January 2, 2025 - Growth Management Hearings Board

  • February 4, 2025 - ELUHO, Pollution Control Hearings Board, Shorelines Hearings Board

 

End Public Comment

The public comment period will conclude. ELUHO will review comments and prepare the rule change package for adoption.

  • January 30, 2025 - Growth Management Hearings Board

  • March 31, 2025 - ELUHO, Pollution Control Hearings Board, Shorelines Hearings Board

 

Rulemaking Order

ELUHO will file rulemaking orders (CR-103P) with the Office of the Code Reviser.

  • February 28, 2025 - Growth Management Hearings Board

  • April 1, 2025 - ELUHO, Pollution Control Hearings Board, Shorelines Hearings Board

 

Rule Effective Date

Adopted rules become effective 31 days after filing.

  • April 2025 - Growth Management Hearings Board
